New law adopted on court fees - What does it mean for you?

On March 9, 2021, the Danish Parliament adopted a bill amending the law on court fees as we have known it so far. But what does this mean for you? Basically, the rules on court fees will be more transparent and simplified to make them easier to use for lawyers, courts and other bodies.

The changes will enter into force on October 1, 2021, and will result in us working on the basis of fixed rates in the enforcement court. For cases in civil court, the rates are calculated on the basis of the value of the case in question.

Proceedings in the enforcement court

If you, as a creditor, choose to submit your case to the enforcement court, you will have to pay a court fee of DKK 750 in future. - regardless of the amount of the claim. The fee is an attachment imposed on your customer.

The court fee of DKK 750 covers the following:

Demand for payment
Attachment of property
Police presentation

The above means that the court fee of DKK 750 covers all future enforcement proceedings, including police production and out-of-court enforcement proceedings requested by the creditor within 12 months from the day the fee is paid. If the request is made after 12 months, a new court fee must be paid.

Civil law cases

For cases to be sent to civil court, there are also changes. For cases under DKK 100,000, a court fee of DKK 750 is payable. For cases above DKK 100,000, the court fee is set at DKK 1,500.

If a case proceeds to a main hearing or further pleadings in civil court, a supplementary court fee is payable. This is determined on the basis of the value of the case.

In the event that a default judgment is obtained, the case is settled or lapses at least 2 weeks before the start of the main hearing, the additional court fee is refunded.
