New law adopted on court fees - What does it mean for you?
On March 9, 2021, the Danish Parliament passed a bill that changes the law regarding court fees as we have known it so far. But what does this mean for you? Basically, the rules regarding court fees will become more transparent and simplified, making them easier to use for lawyers, courts and other bodies.
The changes will take effect on October 1, 2021 and will result in us working on the basis of fixed rates in the bailiff court. For civil court cases, the rates will be calculated based on the value of the case in question.
Cases in the bailiff court
If you as a creditor choose to send your case to the bailiff court, you will have to pay a court fee of DKK 750. - regardless of the size of the claim. The fee is an outlay that is imposed on your customer.
The court fee of DKK 750 covers the following:
- Demand for payment
- Attachment business
- Police presentation
The above means that the court fee of DKK 750 covers all future bailiff services, including police production and outdoor bailiff services, which the creditor requests within 12 months from the day the fee is paid. If the request is made after the 12 months, a new court fee must be paid.

Cases in civil court
For cases to be sent to the civil court, there are also changes. For cases under DKK 100,000, a court fee of DKK 750 is payable. For cases over DKK 100,000, the court fee is set at DKK 1,500.
If a case proceeds to a main hearing or further pleadings in civil court, a supplementary court fee must be paid. This is determined based on the value of the case.
In the event that a default judgment is obtained, the case is settled or dropped no later than 2 weeks before the commencement of the main hearing, the additional court fee will be refunded.
