Important changes to the Civil Procedure Code regarding debt collection cases
On June 15, 2024, changes to the Administration of Justice Act came into effect. These changes may affect your debt collection cases with us:
Longer insolvency period in the bailiff court
- The period has been extended from 6 months to 12 months. Therefore, if a case is rejected due to insolvency, a new court fee must be paid when the case is resubmitted.
New name and higher threshold for small claims
- The small claims process has changed its name to "the simplified process".
- This process covers claims up to DKK 100,000 (previously DKK 50,000). This means we can handle more cases with objections without involving external lawyers.
- In the housing court, the limit remains DKK 50,000. For example, the housing court handles cases regarding rent, deposit, maintenance and utility costs.
New rules for debtor no-shows
- If the debtor fails to appear, real estate, cars and ships can be seized instead of requesting a police appearance.
